Terms of Service

These Terms of Service ("Terms") govern your use of the SvrGuard software and related services (the "Service"). By downloading, installing or using the Service, you agree to these Terms.

1. Service provider

The Service is provided by XUHEI FUYUAN INFORMATION CO LTD (旭黑富源資訊有限公司), a limited company registered in Taiwan (R.O.C.), company number 66557794, registered office at 10F., No. 8, Sec. 1, Zhonghua Rd., Xinzhuang Dist., New Taipei City 242, Taiwan (R.O.C.), trading as SvrGuard (ofuyuan.com, "we", "us").

2. What the Service includes

• Free tier: a no-cost license to use SvrGuard's core protection (detection, blocking, local console, email alerts) on a single host.
• Pro subscription: a paid subscription, billed yearly or monthly, priced per host (one subscription per host, from a single one), providing the threat address database and OTA binary updates. The authoritative feature split is the Pricing page.

3. License scope

We grant you a non-exclusive, non-transferable license to use the software. You may not: resell, rent or sublicense it; reverse-engineer it (except where the law mandates otherwise); circumvent subscription or licensing mechanisms; or use the Service for any unlawful purpose.

4. Accounts and subscriptions

• You are responsible for safeguarding your credentials and device codes, and for activity under your account.
• One host corresponds to one subscription; reinstalling the same host does not consume an additional one. A subscription may be transferred to another host at any time, with no limit on how often and with no change to its expiry date. You may also unbind a host: the subscription is released from it but remains valid with the same expiry date, becoming unassigned and available for another host that has none. A subscription is never unbound because it has lapsed. A cancelled subscription awaiting its expiry date may be neither transferred nor reassigned after unbinding; it stays on its host until that date.
• Every subscription costs US$59 and runs for one year from the day it is bought (yearly), or US$6 and runs for one month (monthly), each with its own expiry date: no proration and no aligning of dates. A subscription cannot switch between yearly and monthly while it runs; to change, cancel it and buy the other kind after it expires. Renewing extends the existing subscription rather than adding another. A cancelled subscription lapses on its own expiry date, and the service runs normally until then. Refunds follow the Refund Policy: on yearly subscriptions, a full refund within 14 days of the first purchase and none after that; monthly subscriptions are not refunded.

5. Payment and renewal

Payments are processed by our reseller Paddle.com Market Ltd (Merchant of Record), which handles billing, taxes and invoices. Subscriptions renew automatically on the billing period you chose (yearly or monthly); you may cancel anytime in the subscription portal, and service continues to the end of the paid term. Refunds follow the Refund Policy.

6. Service changes and your data

• When a subscription expires or is cancelled, Pro features stop, but the software's core protection continues to work (fail-open by design).
• Event and block data on your host is stored on your host and belongs to you.

7. Disclaimer

The software is provided "as is". Security tooling meaningfully reduces risk, but no software can guarantee that every attack is blocked. We do not warrant that the Service will be uninterrupted or error-free, or that it will prevent any particular intrusion. You remain responsible for reasonable practices: system updates, backups and sound configuration.

8. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental or consequential damages arising from use of or inability to use the Service. Our total liability is capped at the subscription fees you actually paid in the 12 months preceding the claim.

9. Changes to these Terms

We may revise these Terms; material changes will be announced on this site with an updated effective date. Continued use after an announcement constitutes acceptance.

10. Governing law

These Terms are governed by the laws of the Republic of China (Taiwan). Disputes shall be submitted to the Taipei District Court, Taiwan, as the court of first instance.
